Preferred candidate must be in the Miami Dade or Broward County area and accessible to the Miami Dade County and Broward County Courthouse. 

SCOPE:

We are seeking an experienced Property Damage and Subrogation Attorney specializing in automobile insurance to join our team. This is a hybrid position and the successful candidate will be responsible for managing both Property Damage and Subrogation lawsuits from inception through resolution.  Additionally, you will work closely with the claims department to ensure legal compliance, mitigate risk, and negotiate settlements. Your role will involve staying current on Florida insurance laws, advising internal teams, and actively participating in mediation, arbitration, and settlement discussions to protect the company’s interests. This position offers a remote work arrangement, allowing the ideal candidate to work from their preferred location within Miami Dade or Broward County.

DUTIES:
  • Strong negotiation skills with respect to handling subrogation and determine the validity of recovery claims against third parties.
  • Advise on legal risk related to policy interpretations, claims settlements, and potential exposure.
  • Stay current with changes in insurance and property damage laws in Florida, ensuring the company is compliant with local, state, and federal laws.
  • Able to assume the existing high caseload.
  • Must be able to work the property damage cases in an efficient and timely manner. 
  • Must be able to negotiate, resolve or attend trials if required against plaintiffs attorneys or pro se claimant.
  • Monitor changes in subrogation law, such as comparative fault rules and recent tort reform and understand how Florida’s “made whole” doctrine affects recovery rights.
SKILLS & EXPERIENCE:
  • Minimum of 3-5 years of experience in handling automobile insurance property damage claims and litigation.
  • Minimum 1 year experience handling automobile insurance subrogation claims and litigation.
  • In-depth knowledge of Florida insurance law, property damage statutes, and litigation procedures.
  • Strong litigation experience with trial skills preferred.
  • Excellent negotiation, oral advocacy, and legal writing skills.
  • Ability to handle a high volume of cases and prioritize effectively.
  • Proficiency in case management software, legal research tools, and Microsoft Office.
  • Experience representing insurance companies in first-party property claims.
  • Knowledge of bad faith litigation and experience with appraisal and mediation processes
EDUCATION:
  • Juris Doctor (JD) from an accredited law school.
  • Admission to the Florida Bar and good standing.
  • Bilingual in English and Spanish is highly desirable.
